Terms of Service
These Terms of Service ("Terms") govern your access to and use of the yiDari mobile application, the website at https://yidari.com, and related services (collectively, the "Service") operated by DressTheDate ("Operator," "we," "us," or "our"). By using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility
You must be at least 18 years old to use the Service. The Service includes optional age-adjustment features for adult portraits and is intended for wedding and formalwear planning. If you do not agree to these Terms, do not use the Service.
2. The Service
yiDari lets you upload or capture a portrait photograph, optionally adjust how an adult age is rendered, browse a catalog of formal dresses from participating designers, and generate AI-assisted visualization images that show how a dress might look on you ("Looks"). Looks are approximations for planning and inspiration. They are not product samples, do not guarantee fit, color accuracy, fabric drape, or availability, and are not offers to sell goods.
Catalog dresses are made available only from designers who have authorized their content for use in the Service. Designer names and links to official product pages are provided for convenience and do not mean that any designer endorses yiDari unless we say so explicitly.
3. Accounts, Devices, and Tokens
The Service uses a device-based identity and API credentials rather than a traditional username and password. You are responsible for activity on your device. Certain features require "dress tokens," which may be granted as promotions or purchased through Apple's In-App Purchase system. Token purchases are processed by Apple and are subject to Apple's terms. Except where required by law or Apple's policies, dress token purchases are non-refundable once consumed. We may grant courtesy token refunds when a try-on clearly fails for technical reasons, at our discretion.
4. Your Content
You retain ownership of portrait photos and other content you submit ("User Content"). You grant us a worldwide, non-exclusive license to host, reproduce, process, modify, and display User Content solely to operate, secure, and improve the Service, including running safety checks and AI generation workflows. You represent that you have all rights necessary to submit User Content and that it does not violate any law or third-party rights.
You may not upload images of minors or anyone who has not consented to processing. You may not submit content that is unlawful, harassing, deceptive, or that impersonates another person.
5. Generated Looks and Ownership
"Looks" are synthetic, AI-generated composite images created for your personal visualization and wedding-planning purposes. They combine your portrait with visual elements derived from catalog dresses or your custom descriptions.
No transfer of designer intellectual property. Nothing in these Terms transfers ownership of a designer's intellectual property to you or to Operator. We do not claim, and do not acquire, any ownership interest in any designer's trademarks, trade names, logos, trade dress, garment designs, product designs, or copyrights in catalog photographs as a result of generating, hosting, or delivering Looks.
Our rights in a Look, if any, are limited to the technical compilation, hosting, and delivery of the composite image as part of the Service. Those rights do not include ownership of underlying designer intellectual property visible or referenced in a Look, such as the design of the garment, fabric patterns, branding, or the original product photograph, except as needed to operate the Service under our agreements with participating designers.
Subject to these Terms, we grant you a personal, non-commercial license to save and share Looks for your own wedding or event planning. That license does not grant you any right to reproduce, manufacture, sell, license, or otherwise exploit a designer's designs, trademarks, or product imagery, and does not create any affiliation with or endorsement by any designer. You may not use Looks to misrepresent affiliation with a designer, resell generated images as stock photography, or use them in advertising without permission from the relevant rights holders.
Looks shared from the app may include a yiDari watermark to indicate that they are generated visualizations from the Service, not official designer marketing materials.
You retain ownership of your portrait and other User Content you submit. Your license to us in Section 4 is separate from, and does not include, any designer's intellectual property shown or referenced in a Look.
6. Designer and Third-Party Content
Dress photographs, descriptions, prices, and trademarks shown in the catalog belong to their respective owners. Participating designers authorize us to use their content in the Service under written agreements in which they represent that they hold a valid chain of title to that content. Those agreements do not grant you any ownership or commercial rights in designer content.
You may not scrape, bulk download, or redistribute catalog images outside the Service. Links to third-party websites are provided for convenience; we are not responsible for third-party sites or purchases you make elsewhere. Designer names and links to official product pages do not mean that any designer endorses yiDari unless we say so explicitly.
7. Acceptable Use
You agree not to:
- reverse engineer, interfere with, or overload the Service;
- bypass safety controls, token limits, or access restrictions;
- use the Service to generate sexual, violent, hateful, or otherwise prohibited imagery;
- submit custom dress descriptions or images designed to evade moderation; or
- use the Service in violation of applicable law.
We may refuse, remove, or restrict content or access if we believe these Terms or our safety policies have been violated.
8. Privacy
Our Privacy Policy explains how we collect and use information. By using the Service, you consent to those practices.
9. Intellectual Property
The Service, including its software, yiDari branding, and compilation of catalog data, is owned by Operator or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks except limited use necessary to refer to the Service.
As described in Section 5, generating a Look does not give Operator or you any ownership interest in a designer's underlying designs, branding, or product photography. Designers retain all intellectual property rights in their content except for the limited license they grant Operator to operate the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT LOOKS WILL BE ACCURATE OR FLATTERING.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR DRESS TOKENS IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) US $100.
12. Indemnification
You will defend and indemnify Operator against claims arising out of your User Content, your misuse of the Service, or your violation of these Terms or third-party rights.
13. Changes
We may update these Terms from time to time. If we make material changes, we will provide notice through the app or website. Continued use after the effective date of updated Terms constitutes acceptance.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except that mandatory consumer protection laws in your place of residence may apply where required. Any dispute will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.
